A local businessman allegedly disposed of property worth US$100 000 in violation of a liquidation order which had been issued by the High Court.
Brian Kudakwashe Matongo was not asked to plead when he appeared before Harare magistrate Isheanesu Matova yesterday.
The complainant is Albitrim Enterprises, which is being represented by Oscar Tafadzwa Gasva, who is a legal practitioner and was appointed as the liquidator.
The court heard that on October 16, 2019, the High Court granted an order, which placed the company under a provisional liquidation.
On December 18, 2019, the High Court issued another order, placing Albritim Enterprises (Pvt) Ltd under liquidation and Gasva was nominated as the liquidator.
The company declared its assets as two Freight Liners FLD 120 Horses, registration numbers ADC 1047 & ADC 1048, one international Horse reg number ADC 7365, a Homemade Trailer registration ACZ 9845, a Tandem Local Trailer ACZ 9975 and a Trinity Local Semi Trailer registration number AEG 1774.
It is the State case that Matongo, knowing very well that an order by the High Court had been granted and that he was not supposed to conduct any business or to dispose any of the assets without the knowledge and permission of Gasva, violated this order by disposing the assets and converted the money to his own personal use.
The total value stolen was US$100 000 and nothing was recovered.
