Sex deprived wife Noria Garai (20), was bashed by her husband Brighton Madzinga, for demanding to have sexual intercourse with him, the Mbare Magistrates’ Court heard.
The 25-YEAR-OLD Madzinga , yesterday appeared before the court where he pleaded guilty to battering his wife after she demanded her conjugal rights.
Madzinga appeared before magistrate Tafadzwa Miti, who convicted him on physical abuse charges and remanded him out of custody to today for sentence.
The court heard Madzinga and his wife, had had a sour relationship since March this year when Garai, then his girlfriend, claimed she was pregnant.
“She demanded to have sexual intercourse with me on Thursday regardless of the fact that I have denied her the conjugal rights for the past three months,” Madzinga said.
Allegations against him were that on the day in question at around midnight, Garai made sexual advances towards him, but he refused.
The court heard that a misunderstanding then arose between the two, prompting Madzinga to clap Garai in the face and also beat her several times with a belt on her back.
Garai sustained injuries on her lips, but did not go for medical examination.
In mitigation, Madzinga told the court he was not comfortable with having sexual intercourse with Garai because he was disputing responsibility for her pregnancy.
“She also refused to take a pregnancy test earlier that same day, so I was angry,” Madzinga said.
Prosecutor Gerald Date urged the court to impose a heavy fine, saying although Madzinga had been provoked by Garai, he ought not to have taken the law into his own hands. Newsday
